1. Who we are

Cherokee AI Solutions ("Cherokee AI," "we," "us") is operated by Cherokee AI Solutions LLC. By signing up at cherokeeai.com you ("Client," "you") agree to these terms.

2. What the service does

Cherokee AI provides software automations — including AI-drafted email replies, follow-up sequences, review request automation, appointment scheduling, and weekly performance digests — that operate on the email account and customer data you connect to your account.

3. Your responsibilities

You are the operator of your business. You are solely responsible for:

Reviewing and approving outbound communications during your first 7 days and any time we flag a draft for review.
The legal compliance of communications sent on your behalf (CAN-SPAM, TCPA, state-specific consumer protection rules, etc.).
Customer commitments, pricing, scheduling, refunds, and warranty obligations.
The accuracy of business information (hours, service area, pricing) you provide to us.
Securing your account credentials, including the email app password you provide.

4. What we are not

Cherokee AI is a tool, not an employee, agent, fiduciary, or representative of your business. We do not provide legal, financial, tax, accounting, or business advice. AI-generated content may contain errors. Treat every draft as a draft.

5. Acceptable use

You will not use Cherokee AI to:

Send spam, phishing, or any unsolicited bulk communication.
Impersonate any person or business.
Violate any law, regulation, or third-party right.
Reverse-engineer, scrape, or attempt to extract our model weights or proprietary code.

6. Subscription, billing, and cancellation

Subscriptions billed monthly via one of: bank wire / Zelle, Wise, card (Lemon Squeezy merchant of record), PayPal, or crypto (NOWPayments). You may cancel at any time; cancellation takes effect at the end of the current billing period. Monthly fees are non-refundable for the month in which they were charged. Setup fees, where applicable, are non-refundable once the build has shipped.

7. Free audit

The AI Business Audit is offered free of charge. After your audit we scope a custom setup (Small or Big) and quote the monthly price; you choose whether to proceed. Nothing is charged until you sign and pay at checkout.

8. Service changes

We may add, remove, or change features at any time. We will give 30 days' notice for material adverse changes to the agents you have enabled, via email to your account address.

9. Termination

We may suspend or terminate accounts for non-payment, violation of these terms, or abuse. We will give you reasonable notice and an opportunity to export your data, except in cases of suspected fraud or imminent harm to others.

10. Disclaimer and limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, Cherokee AI's total liability for any claim arising out of or relating to this agreement shall not exceed the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost customers, or lost data.

11. Indemnification

You agree to indemnify Cherokee AI against any claim arising from communications sent through your account, your customer relationships, your business activities, or your violation of these terms.

12. Governing law

These terms are governed by the laws of the state in which Cherokee AI Solutions LLC is registered, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts of that state.

13. Changes to these terms

We will notify you of material changes by email and post the updated terms here. Continued use after the effective date constitutes acceptance.
